General Terms and Conditions (AGB)
1. scope of application
1.1 These General Terms and Conditions (GTC) apply to all contracts between REXMA LTD, Punchbowl Centre, Elia Zammit Street, St Julian's 3154 Malta (hereinafter referred to as "Provider") and the users (hereinafter referred to as "Customers") regarding membership in the premium member area of Growstruction.
1.2 Deviating, conflicting or supplementary general terms and conditions of the customer shall not become part of the contract unless their validity is expressly agreed.
2. subject matter of the contract
2.1 The Provider offers membership in the premium member area of Growstruction, which enables access to exclusive content on the website.
2.2 Access to the premium member area is granted immediately after successful registration and payment.
3. conclusion of contract
3.1 The presentation of the membership on the website does not constitute a legally binding offer, but an invitation to place an order.
3.2 By completing the order process, the customer submits a binding offer to conclude a membership contract. The contract is concluded by the confirmation of the provider by e-mail.
4 Prices and terms of payment
4.1 The price for membership is €79 gross per month.
4.2 The fee is payable monthly in advance. The customer will receive a corresponding invoice by e-mail.
4.3 Payment is made using the payment methods offered by the provider.
5. right of withdrawal
5.1 Consumers (B2C) are entitled to a right of withdrawal in accordance with the statutory provisions.
5.2 In order to exercise the right of withdrawal, the customer must inform the provider by means of a clear statement (e.g. a letter sent by post or e-mail) of his decision to withdraw from this contract.
6. liability
6.1 The provider is only liable without limitation for intent and gross negligence as well as for damages resulting from injury to life, body or health.
6.2 The Provider shall only be liable for slight negligence in the event of a breach of material contractual obligations (cardinal obligations). In this case, the liability of the provider is limited to the damage foreseeable at the time of conclusion of the contract and typical for the contract.
7. data protection
7.1 The provider undertakes to collect, process and use the customer's personal data only in accordance with the statutory provisions of data protection law.
7.2 Further information on data protection can be found in the provider's privacy policy, which is available on the website.
8 Contract term and termination
8.1 Membership runs for an indefinite period and can be terminated by the customer at any time with one month's notice to the end of the month.
8.2 Notice of termination must be given in writing (letter or e-mail).
9. final provisions
9.1 Contracts between the Provider and the Customer shall be governed by the laws of the Republic of Malta to the exclusion of the UN Convention on Contracts for the International Sale of Goods.
9.2 If the customer is a merchant, a legal entity under public law or a special fund under public law, the place of jurisdiction for all disputes arising from contractual relationships between the customer and the provider is the registered office of the provider.
9.3 Should individual provisions of these GTC be or become invalid, the validity of the remaining provisions shall remain unaffected.
